Title IX

The Title IX Coordinator shall report directly to the Superintendent. Questions about this policy should be directed to the Title IX Coordinator. 

Enacted in 1972, Title IX is a Federal civil-rights law that protects everyone from being discriminated against on the basis of sex in educational programs and activities. Although Title IX has improved educational access for millions of students, sexual harassment continues to be a widespread problem. In May of 2020, the U.S. Department of Education (DOE) updated its guidelines for how schools must respond to sexual-harassment claims. The guidelines, which are effective August 14, 2020, apply to all types of sexual harassment, including student against student, student against school employee, school employee against school employee, and school employee against student. One of the new guidelines most important changes is that all employees, without delay, must report possible acts of sexual harassment to a Title IX coordinator. This course will: define sexual harassment; explain schools’ obligations with regards to sexual-harassment claims under Title IX; and outline Title IX investigative procedures.

Anti-Harassment

Per Policy 5517- follow this link to view full Policy,  the Governing Board of the ESC of the Western Reserve is to maintain an education and work environment that is free from all forms of unlawful harassment, including sexual harassment. This commitment applies to all ESC operations, programs, and activities. All students, administrators, teachers, staff, and all other school personnel share responsibility for avoiding, discouraging, and reporting any form of unlawful harassment. Our Harassment policy applies to unlawful conduct occurring on school property, or at another location if such conduct occurs during an activity sponsored by the Governing Board. 


If you have been subjected to unlawful harassment, you may seek resolution and report a compliant, by submitting a HARASSMENT REPORT

Per Policy 1422- follow this link to view full Policy, the Governing Board of the ESC of the Western Reserve does not discriminate on the basis of race, color, national origin, sex, disability, age, religion, military status, ancestry, genetic information (collectively, "Protected Classes"), or any other legally protected category, in its programs and activities, including employment opportunities. The Governing Board designates the following individual to serve as the ESC's "Compliance Officer" (also known as "Civil Rights Coordinator").

The Compliance Officer is responsible for coordinating the ESCWR's efforts to comply with applicable Federal and State laws and regulations, including the ESC's duty to address in a prompt and equitable manner any inquiries or complaints regarding discrimination/retaliation or denial of equal access. The Compliance Officer shall also verify that proper notice of nondiscrimination for Title II of the Americans with Disabilities Act (as amended), Title VI and Title VII of the Civil Rights Act of 1964, Title IX of the Education Amendment Act of 1972, Section 504 of the Rehabilitation Act of 1973 (as amended), and the Age Discrimination in Employment Act of 1975 is provided to staff members and the general public. 
Non Discrimination on the Basis of Sex in Education Programs or Activities
Per Policy 2266- follow this link to view full Policy, the Governing Board of the ESC of the Western Reserve does not discriminate on the basis of sex (including sexual orientation or gender identity),  in its education programs or activates, and is required by Title IX of the Education Amendments Act of 1972, and its implementing regulations, not to discriminate in such a manner. The requirement not to discriminate in its education program or activity extends to admission and employment. The Governing Board is committed to maintaining an education and work environment that is free from discrimination based on sex, including sexual harassment. 

The Governing Board prohibits Sexual Harassment that occurs within its educational programs and activities. When the Governing Board has actual knowledge of Sexual Harassment in its education programs or activity against a person in the United States, it shall promptly respond in a manner that is not deliberately indifferent.

Pursuant to its Title IX obligations, the Governing Board is committed to eliminating Sexual Harassment and will take appropriate action when an individual is determined responsible for violating this policy. Governing Board employees, students, third-party vendors and contractors, gusts, and other members of the School Center community who commit Sexual Harassment are subject to the full range of disciplinary sanctions set forth in this policy. The Governing Board will provide persons who have experienced Sexual Harassment ongoing remedies as reasonably necessary to restore or preserve access to the Governing Board's education programs and activities.

The Governing Board of the ESC of the Western Reserve recognizes that from time to time the public may have questions regarding the operations of the ESCWR. Public records requests may be submitted to our offices via the below methods.

Upon receipt of the public records request, the request will be logged into our system and we will confirm the receipt of the request within 24 hours. Within 72 hours we will contact the submitter with the requested information or notification if the request will take longer to fulfill.
